Abstract

As legal and medical scholars writing on genetic privacy we commend Professor Otlowski for her article “Australian Reforms Enabling Disclosure of Genetic Information to Genetic Relatives by Health Practitioners”.1 Professor Otlowski’s interpretation of the s 95AA amendments is valuable, given her involvement in the consultation process2 to develop the joint National Health and Medical Research Council (NHMRC) and Office of the Privacy Commissioner Use and Disclosure of Genetic Information to a Patient’s Genetic Relatives under Section 95AA of the Privacy Act 1988 (Cth): Guidelines for Health Practitioners in the Private Sector (the Guidelines).3
