Abstract

This presentation discuses emerging forms of identification evidence, with a specific focus on recent developments in biometrics. The impact of new biometric applications has significant implications for law enforcement as well as the legal system. These will be discussed in a review of relevant case law, legislation and empirical evidence with a focus on Australia, but including examples from the United States and United Kingdom. Examining the implications of these new developments contributes to an understanding of how the criminal law should best be adapted to ensure that new technology is used to enhance criminal investigation and prosecution, while maintaining the admissibility standards of the legal system.
