Abstract

Partner rape - marital rape immunity formally abolished - but archaic construction of wives as chattels continues to appear in sexual assault cases where the partner is the perpetrator - contradictory interpretations of consent and its vitiation are contrasted - low disclosure and reporting rates - high rate of discontinued cases - judges and juries attitudes to sexual coercion in relationships.
